Upper Valley Princess Parties LLC – Terms & Conditions
These Terms and Conditions (“Terms”) are incorporated into and govern every agreement between Upper Valley Princess Parties LLC (“Entertainer”) and the undersigned customer (“Customer”) upon submission of a booking request, invoice, or Order Form. These Terms form a legally binding contract under the laws of New Hampshire and Vermont.
1. Scope of Services
Customer has requested Entertainer provide character-based entertainment as outlined in the booking confirmation (“Services”). Services may include one or more costumed performers (“Character(s)”) engaging in party activities at the Customer’s designated event location. Services are limited to the time, activities, and characters specified in the confirmation.
2. Fees & Payment
● The Customer agrees to pay the total amount stated in the invoice/order form.
● A non-refundable deposit of $150 is due at the time of booking to secure your date and character.
● Remaining balances must be paid no later than 48 hours before the scheduled event, unless otherwise agreed.
● Credit card payments are subject to a 3.5% processing fee.
3. Cancellation & Rescheduling Policy
● Customer may reschedule one time with at least 7 days’ notice, subject to availability.
● If canceled more than 7 days in advance: a refund may be issued minus 40% of the total fee.
● If canceled less than 7 days before the event, and no reschedule is requested: no refund will be issued.
● Entertainer reserves the right to cancel or reschedule due to illness, inclement weather, unsafe conditions, or other uncontrollable circumstances (see Section 9).
4. Assumption of Risk & Waiver of Liability
Customer, on behalf of themselves, their child(ren), guests, and all event attendees, knowingly assumes all risks associated with the Services. Risks may include, but are not limited to, emotional distress, allergic reactions, accidental injuries, and unforeseen hazards.
By booking, Customer waives and releases Entertainer (including owners, employees, contractors, and agents) from any and all claims or liability, known or unknown, arising out of the performance of the Services. Customer agrees to inform all event guests of this waiver and assumes responsibility for doing so.
5. Character Representation Disclaimer
Our Characters are inspired by classic fairytales and literature in the public domain and are not affiliated with, endorsed by, or licensed by any third-party companies or franchises. If you are seeking a trademarked character, we recommend contacting the appropriate rights holder.
6. Non-Disparagement Agreement
Customer agrees not to make or encourage negative, false, or defamatory statements about Entertainer, including via social media, reviews, or other public platforms. Each violation may result in liquidated damages of $1,000 per incident, plus additional legal remedies including injunctions.
7. Indemnification
Customer agrees to defend, indemnify, and hold harmless Entertainer from any claims, losses, injuries, damages, or legal costs arising out of or in connection with the Services, including any conduct by Customer or event guests.
8. Damage to Costumes or Property
Customer is responsible for any damage to costumes, props, wigs, accessories, or materials caused by guests, pets, or environmental hazards. The Customer agrees to:
● Keep food, drinks, and staining substances away from Characters.
● Avoid excessive physical contact or interference with performers.
If damage occurs, Customer agrees to reimburse repair or replacement costs, which may be charged to the card on file.
9. Acts of God / Force Majeure
Entertainer is not liable for cancellations or delays due to weather, illness, accidents, or other force majeure events. In such cases, Entertainer will work with the Customer to reschedule Services or issue a partial or full refund, at Entertainer’s discretion.
10. Time Limits & Overtime Fees
Characters will arrive and leave based on the confirmed schedule. If the Customer requests additional time and Entertainer agrees, Customer will be charged $100 per additional 30 minutes (or portion thereof).
11. Photo & Video Use
Customer agrees that any photo or video taken by or on behalf of Entertainer may be used in marketing, social media, and promotional material.
Customer also agrees not to use images or videos of Characters for commercial purposes without prior written consent. Personal use (e.g., sharing on social media) is permitted and encouraged!
12. Behavioral Expectations & Event Rules
Customer is responsible for ensuring that guests behave appropriately and respectfully during the event.
Entertainer reserves the right to terminate Services without refund if unsafe or inappropriate conditions arise.

13. Governing Law & Venue
This Agreement shall be governed by and enforced under the laws of the State of New Hampshire and the State of Vermont. Any legal action must be brought in the courts of Windsor County, Vermont or Grafton County, New Hampshire, depending on jurisdiction.
14. Attorney’s Fees
In any dispute, each party shall bear its own attorney’s fees unless otherwise awarded by a court of law.
15. Entire Agreement & Updates
This Agreement is the full understanding between Customer and Entertainer. It supersedes all prior agreements or communications.

By booking your party and submitting payment, you confirm that you have read, understood, and agree to all of the Terms & Conditions listed above.
